RE: Non-payment of Court Ordered Child Support
[Name of Non-Payor]
This letter is to inform you again that there is presently a court order for support payment: for which you are presently in contempt. You are hereby notified that if you fail to contact me within the next ten (10) days, and make satisfactory arrangements for bringing support payments current within the next thirty (30) days -- I am prepared, and will, take the following steps:
Your parents, friends, neighbors, church, creditors and local law enforcement agencies will be contacted on a regular basis and advised of your non-support of your children; and that you are in contempt of court.
Posters will be prepared for posting around your place of employment, home, etc. advising the general public of your non-support, and that you are a "dead-beat."
Your credit will be ruined by advising TRW Credit Bureau of your arrearages in support payments.
Other steps may be taken by my family and friends.
A "Motion to Enforce Order by Contempt, To Confirm Arrearage And Render Judgment, To Withhold From Earnings or For Security" will be filed with the Court of Continuing Jurisdiction. This "Motion For Contempt" will result in a JUDGEMENT against you; along with a possible jail sentence.
If you are employed, automatic mandatory wage withholding (payroll deduction) is available to me (Federal Law P.L. 98-378).
If you are unemployed, unemployment compensation is attachable for child support under Federal Law P.L. 97-35. The court may order you to seek employment and provide proof to the court that you are looking for work.
If you are an "under-the-table" earner, I can order a credit check to determine assets. Your assets, a judgement can attach your assets for back child-support.
If you place your assets in someone else's name, I will prove "fraudulent conveyance" to the court.
If you are out of state, or move out of state, and your arrearage is over $750.00: I will use the Internal Revenue Service Collection Services to collect back support.
If you are self-employed:
1. Federal Law P.L. 98-378 requires that states have a law for posting a bond to ensure payment.
2. I will file CRIMINAL NON-SUPPORT CHARGES at the County Attorney's Office.
I wish to caution you again that if I have not heard from you in ten (10) days, the aforementioned actions will be implemented. Further, as a member of ACES, I have access to professional skip-trace procedures: you will be found and brought to court here.
Sincerely,
[Your Name]

In the alternative, Movant requests a money judgment against Respondent be awarded to Movant in the amount of $ .

Finally, the reader learns how the appeals process works and the effects it can have on a judgment. The discussion of basic legal principles and their practical application enables the reader to think like a lawyer (if you should want to do something evil like that) to evaluate the strength or weakness of a case.
